Common Types of Assault Charges

  1. Aggravated Assault

  2. Assault Family Violence

  3. Simple Assault

  4. Assault by Contact

Aggravated Assault is a serious charge. It is typically a 2nd degree felony, punishable by 2 to 20 years in prison and a $10,000 fine. Under certain circumstances, it can be charged as a 1st degree felony (5 to 99 years in prison). A case of aggravated assault usually involves either serious bodily injury or the use of a deadly weapon such as a firearm.

Assault family violence is a Class A Misdemeanor, punishable by up to 1 year in jail and a $4,000 fine. Although it is a misdemeanor, it has serious consequences, such as a lifetime ban on firearm ownership under federal law. If you are charged with Assault Family Violence with a Previous Conviction, the charge is enhanced to a 3rd degree felony (2 to 10 years in prison). Assault Family Violence charges do not require serious bodily injury, the state only needs to prove that the conduct caused pain.

Simple Assault is usually a Class B Misdemeanor, punishable by up to 6 months in jail and a $2,000 fine. This charge similarly requires the state to prove that the accused's actions caused pain. As long as the complainant was not a family member or someone with whom you had a dating relationship, most assaults are charged as simple assaults.

Assault by Contact is a Class C Misdemeanor, punishable by only a $500 fine. This offense only requires the state to prove an "offensive" touching even if there was no pain. Although the punishment is minimal, you do not want an assault conviction on your record, especially a Class C Family Violence Assault, which can have other collateral consequences.
